Terms of Service

When you purchase or book a session with Wanderlust Photography LLC, you agree to the following terms:

ENTIRE AGREEMENT: This agreement contains the entire understanding between Wanderlust Photography LLC and the CLIENT/MODEL(S). It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

RESERVATION & REFUND POLICY: A signed contract and session fee (ranging from $175-$2499+Tax) is required to reserve the dates and times of the EVENT(S). If the EVENT(S) is rescheduled, postponed, or canceled; or if there is a breach of contract by the CLIENT/MODEL(S), the session fee is NON-REFUNDABLE and shall be liquidated damages to Wanderlust Photography LLC. The CLIENT/MODEL(S) shall also be responsible for payment for any of Wanderlust Photography LLC's materials charges incurred up to the time of cancellation. The session fee does not include any images unless otherwise agreed upon by Wanderlust Photography LLC | Wanderlust Boudoir.

 SAFETY: Wanderlust Photography LLC reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer from Wanderlust Photography LLC experiences inappropriate, threatening, hostile, or offensive behavior from the CLIENT/MODEL(s) at the EVENT(S); or in the event that the safety of the photographer from Wanderlust Photography LLC is in question.

SHOOTING TIME / ADDITIONS: The CLIENT/MODEL(S) and Wanderlust Photography LLC agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT/MODEL(S) does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT/MODEL(S).

RESPONSIBILITIES: Wanderlust Photography LLC is not responsible for compromised coverage due to causes beyond the control of Wanderlust Photography LLC including but not limited to obtrusive guests, the lateness of the CLIENT/MODEL(S) or guests, weather conditions, schedule complications, incorrect addresses provided to Wanderlust Photography LLC, rendering of decorations, or restrictions of the locations. Wanderlust Photography LLC is not responsible for backgrounds or lighting conditions that may negatively impact or restrict the photo coverage. Wanderlust Photography LLC is not held liable for missed coverage of any part of the EVENT(S). Wanderlust Photography LLC will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S).

VENUE AND LOCATION LIMITATIONS: Wanderlust Photography LLC is limited by the rules and guidelines of the location(s) and site management. The CLIENT/MODEL(S) agrees to accept the technical results of their imposition on Wanderlust Photography LLC. Negotiation with the officials for moderation of guidelines is the CLIENT/MODEL(S) responsibility; Wanderlust Photography LLC will offer technical recommendations only. 

FILM and COPYRIGHTS: The photographs produced by Wanderlust Photography LLC are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Wanderlust Photography LLC's explicitly written permission. Wanderlust Photography LLC grants the CLIENT/MODEL(S) permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered. The CLIENT/MODEL(S) must obtain written permission from Wanderlust Photography LLC prior to publishing or selling the photographs.

MODEL RELEASE: The CLIENT/MODEL(S) hereby assigns Wanderlust Photography LLC the irrevocable and unrestricted right to use and publish photographs of the CLIENT/MODEL(S) or in which the CLIENT/MODEL(S) may be included, for editorial, trade, advertising, educational, and any other purpose and in any manner and medium; to alter the same without restriction and to copyright the same without restriction. The CLIENT/MODEL(S) releases all claims to profits that may arise from the use of images.

LIMIT OF LIABILITY REGARDING PRINTS: In the unlikely event that the assigned photographer from Wanderlust Photography LLC is unable to perform to the guidelines of this contract due to an injury, illness, the act of God, the act of terrorism, or other cause beyond the control of Wanderlust Photography LLC, every effort will be made to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability are limited to the return of all payments received for the EVENT(S). In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond Wanderlust Photography LLC's control, including but not limited to camera, hard drive, or equipment malfunction, Wanderlust Photography LLC's liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of a total number of originals. Wanderlust Photography LLC is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.

POST PRODUCTION AND EDITING: The final post-production and editing styles, effects, and overall look of the images are left to the discretion of Wanderlust Photography LLC.

PAYMENT SCHEDULE: The aforementioned Session Fee (ranging from $175-$2499+Tax) is a non-refundable session fee that is due at the time of signing of the agreement. In the event the CLIENT/MODEL(S) fails to remit payment as specified, Wanderlust Photography LLC shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S). Please note, that the session fee does not include any prints, products, or digital files.

PRICING: Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward merchandise purchased from Wanderlust Photography LLC. Any products sold are final and non-refundable.

CAPTURE AND DELIVERY: Wanderlust Photography is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT/MODEL(S) is left to the discretion of Wanderlust Photography LLC.

LIABILITY AND ACCIDENT WAIVER: By completing and signing this contract the CLIENT/MODEL(S) acknowledges that the CLIENT/MODEL(S) agrees to and understands the terms and conditions herein. The CLIENT/MODEL(S) is waiving certain legal rights, including the right to sue Wanderlust Photography LLC, its organizers, and members. Please read this contract carefully. I, the participant, acknowledge that participation in any photographic event or any other outdoor activity organized by Wanderlust Photography LLC carries with its inherent risks including, but not limited to, the risk of injury or death. The CLIENT/MODEL(S) freely accepts and fully assumes all such risk(s). It is the responsibility of each participant of a trip to familiarize themselves with the risks of the activity, weigh those risks against the advantages, and decide whether to participate. Wanderlust Photography LLC cannot and will not assume liability in respect of any of these risks, dangers, hazards, and liabilities. The CLIENT/MODEL(S) further acknowledges that it is their responsibility to ensure that they carry adequate medical, extended health, dental, and accident insurance coverage, as well as adequate protection for personal possessions that cover high-value items such as cameras and lenses. It is the responsibility of the CLIENT/MODEL(S) to verify that they are in good health and are physically capable of carrying out the activity. I am aware that the organizers are not responsible for my safety while participating in such an activity. The CLIENT/MODEL(S) is aware that Wanderlust Photography is not responsible for the safety of the CLIENT/MODEL(S). The CLIENT/MODEL(S) acknowledges that Wanderlust Photography LLC is not responsible for providing transportation to and from the activity location and the CLIENT/MODEL(S) must make their own private arrangements for my transportation. If the CLIENT/MODEL(S) chooses to participate in carpooling with another CLIENT/MODEL(S) in a particular event, then the CLIENT/MODEL(S) chooses to do so entirely at the CLIENT/MODEL(S) own risk and without any right to claim against the Wanderlust Photography LLC for any loss, damages, or personal injury whatsoever I may suffer. The CLIENT/MODEL(S) agrees to assume all the risks and responsibilities associated with my transportation to and from the activity location. When Wanderlust Photography is the organizer of events, the fact that their activities outdoors mean that Wanderlust Photography LLC cannot be expected to control every aspect of the event. Everyone is responsible for their own actions during an event. In consideration of being allowed to participate, the CLIENT/MODEL(S) releases Wanderlust Photography LLC and its organizers all liability in respect of any personal injury suffered, any damage or loss of personal property, which may arise out of participation in a photography-related activity.
